Terms of Service

These Terms of Service ("Terms") govern your use of the Archgate Plugins Service operated by Dasolve AS (Org.nr 936 035 019), Lillogata 5P, 0484 Oslo, Norway ("Archgate", "we", "us", "our").

By creating an account or using the Plugins Service, you agree to these Terms. If you do not agree, do not use the service.

1. Scope

These Terms apply to:

  • The Archgate Plugins Service at plugins.archgate.dev (account creation, authentication, and plugin distribution)
  • Any API endpoints provided for plugin downloads and token management

These Terms do not apply to:

  • The Archgate CLI open-source software, which is licensed under Apache-2.0 (see LICENSE)
  • The documentation site at cli.archgate.dev (informational, no account required)
  • The marketing website at archgate.dev (informational, no account required)

2. Eligibility

You must be at least 13 years old to create an account. By using the service, you represent that you meet this age requirement. If you are under 18, you represent that your legal guardian has reviewed and agrees to these Terms.

3. Account terms

3.1 Account creation

To use the Plugins Service, you must authenticate via archgate login, which initiates a GitHub OAuth Device Flow. By completing this flow, you authorize us to retrieve your GitHub username and the email address associated with your GitHub account.

3.2 Account responsibility

You are responsible for:

  • Maintaining the security of your authentication token
  • All activity that occurs under your account
  • Notifying us promptly at privacy@archgate.dev if you suspect unauthorized use

3.3 Account limits

  • One account per person
  • Tokens must not be shared with other users or services
  • Automated access must comply with our rate limits

4. Acceptable use

You agree not to:

  • Share, sell, or redistribute authentication tokens
  • Circumvent rate limits, access controls, or security measures
  • Reverse-engineer, scrape, or systematically download plugins beyond normal CLI usage
  • Use the service for any unlawful purpose
  • Impersonate another user or misrepresent your identity
  • Interfere with or disrupt the service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Intellectual property

5.1 Archgate CLI

The Archgate CLI is open-source software licensed under Apache License 2.0. Your rights to use, modify, and distribute the CLI are governed by that license, not these Terms.

5.2 Official plugins

Plugins distributed through the Plugins Service are proprietary software owned by Dasolve AS unless otherwise stated. You are granted a non-exclusive, non-transferable license to use official plugins with the Archgate CLI for their intended purpose. You may not decompile, reverse-engineer, or redistribute official plugins.

5.3 Your content

You retain all rights to your own content (ADRs, rule files, source code, project configurations). The Archgate CLI and Plugins Service do not access, collect, or transmit your source code or ADR content.

5.4 Trademarks

"Archgate" and the Archgate logo are trademarks of Dasolve AS. The Apache-2.0 license does not grant trademark rights. You may not use our trademarks to imply endorsement without written permission.

6. Service availability

6.1 Beta status

The Plugins Service is currently in beta. We make no guarantees regarding uptime, availability, or feature completeness.

6.2 Modifications

We may modify, suspend, or discontinue the service (or any part of it) at any time. For material changes that affect existing users, we will provide at least 14 days' notice via the CLI changelog or documentation site.

6.3 Maintenance

Scheduled maintenance may temporarily interrupt service availability. We will endeavor to provide advance notice when possible.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DASOLVE AS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The service will be uninterrupted, secure, or error-free
  • Plugins will meet your specific requirements
  • Defects will be corrected within any particular timeframe

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DASOLVE AS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR NOK 500, WHICHEVER IS GREATER.

These limitations apply even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

9. Termination

9.1 By you

You may terminate your account at any time by:

  1. Running archgate login logout to revoke your token locally
  2. Contacting privacy@archgate.dev to request deletion of your account data from our servers

9.2 By us

We may suspend or terminate your account immediately if you violate these Terms. For terminations not related to a Terms violation, we will provide 14 days' notice.

9.3 Effect of termination

Upon termination:

  • Your authentication token will be invalidated
  • Your access to plugins via the service will cease
  • Account data will be handled in accordance with our Privacy Policy
  • Provisions that by their nature should survive (including Sections 5, 7, 8, 10, and 11) will remain in effect

10. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the service shall be resolved by the Norwegian courts at the defendant's domicile (Norwegian: "verneting ved saksoktes hjemsted"), in accordance with the Norwegian Dispute Act (tvisteloven).

Before initiating legal proceedings, both parties agree to attempt to resolve disputes informally by contacting privacy@archgate.dev. We will endeavor to respond within 14 days.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the "Last updated" date at the top of this page
  • We will provide notice through the Archgate CLI changelog or documentation site at least 30 days before the changes take effect

Your continued use of the service after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the service and terminate your account.

12. General provisions

12.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dasolve AS regarding the Plugins Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

12.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
